Consumer Health Data Privacy Notice

This Consumer Health Data Privacy Notice supplements the Strength Side Privacy Policy and applies to consumer health data that Strength Side LLC collects through REPS and related Services. It is intended to provide the disclosures and rights required by Washington’s My Health My Data Act and similar consumer health privacy laws. If this Notice conflicts with the general Privacy Policy regarding consumer health data, this Notice controls for that data.
1. Consumer health data we collect
Consumer health data means personal information linked or reasonably linkable to a person that identifies or may be used to infer the person’s past, present, or future physical or mental health status. Depending on how you use REPS, we may collect:
- workouts completed or marked complete;
- exercise selections, levels, regressions, and progressions;
- rep and set counts, program progress, completion history, and streaks;
- exercise preferences;
- app interactions that reveal workout activity or training progress; and
- inferences needed to calculate progress, recommend an available exercise level, or personalize the requested training experience.
At launch, REPS does not connect to Apple Health or HealthKit and does not request access to health or fitness information stored on your device. If a future version adds such an integration, this Notice will be updated before collection and REPS will request any consent or device permission required by law.
2. Sources of consumer health data
- you, when you select an exercise level, log reps or sets, mark a workout complete, or otherwise use a workout feature;
- your interactions with REPS, when the app records program progress, completion history, streaks, or related events needed to provide the Service.
3. Why we collect and use consumer health data
- provide the workouts, logging, history, progress, streaks, and personalization you request;
- sync the requested experience with your account and across supported sessions or devices;
- remember exercise selections and available levels;
- provide support, troubleshoot problems, and protect the security of REPS; and
- improve REPS using aggregated or de-identified information where reasonably possible.
We collect and use these entries to the extent necessary to provide the REPS features you request. We do not collect, use, or share additional categories of consumer health data, or use collected consumer health data for a materially different purpose, without updating this Notice and obtaining consent when required.
4. Consumer health data we disclose
We do not sell consumer health data. We do not share it with advertisers, data brokers, corporate affiliates, coaches, or brand partners. Strength Side staff do not routinely review individual workout histories. Providers acting as our processors may access consumer health data only as necessary to provide the REPS features you request, secure and troubleshoot the app, respond to a support request you initiate, or honor deletion. Processor categories include cloud hosting and database storage, API and app infrastructure, authentication, diagnostics, security, and deletion support. Content and video providers may process limited network and request information needed to deliver Strength Side exercise media, but are not used to analyze individual workout histories.
5. Your consumer health data rights
Subject to applicable law, you may:
- confirm whether we collect, share, or sell your consumer health data and access that data;
- obtain a list of third parties and affiliates with whom it was shared or sold, if any;
- withdraw consent to future collection or sharing;
- request deletion of your consumer health data; and
- appeal our refusal to act on a request.
Submit a request through an available in-product privacy control or by emailing yo@strengthside.com with “Consumer Health Data Request” in the subject line. You do not need to create a new account to exercise a right, although you may be asked to use an existing account or provide information reasonably necessary to verify your identity. We will not unlawfully discriminate against you for exercising a right.
We will respond without undue delay and within the period required by law, generally 45 days after receiving the request. Where permitted, we may extend once by up to 45 additional days and will explain the reason. If we deny a request, we will explain why and provide an appeal method. You may appeal by replying to our decision or emailing yo@strengthside.com with “Privacy Appeal” in the subject line.
6. Deleting consumer health data
After we authenticate a valid deletion request, we will delete the consumer health data from our active records and notify relevant processors, contractors, affiliates, and other recipients that must honor the request. Deletion from archived or backup systems may be delayed until the system is restored or rotated, but will be completed within the period required by law and no later than six months for Washington requests, unless an applicable exception permits retention. We may retain limited information when the law permits or requires it, such as records needed to prevent fraud, protect security, complete a requested transaction, or establish or defend legal claims.
7. Withdrawing consent
You may withdraw consent to future optional collection or disclosure using the applicable in-app or device control or by contacting us. Withdrawal does not affect processing that occurred lawfully before withdrawal. If the data is necessary to provide a feature you requested, withdrawing consent may disable that feature; we will explain the effect before you complete the choice.
8. Security
We restrict access to consumer health data to personnel and processors that need it for the purposes described in this Notice. We use administrative, technical, and physical safeguards appropriate to the nature and volume of the data, but no system can guarantee absolute security.
9. Changes to this Notice
We will not collect, use, or disclose new categories of consumer health data, or use it for materially different purposes, without first updating this Notice and obtaining affirmative consent when required by law. We will update the “Last updated” date and provide any additional notice required.
